Head Injury Motorbike Accident Victim Appeal Against Decision He Must Return To Work

A motorcyclist enthusiast who suffered a severe brain injury has been told that he is fit enough to return to work.

Zan Marseilles had a motorbike accident in 2007 in Nurburgring, Germany. His crash was so bad that his helmet split in the collision and he suffered injuries to his head that has meant impaired walking, speech and balance as well as a decreased use of his right arm.

Prior to his accident, Mr Marseilles owned properties and two construction companies but lost them all because he did not have life insurance at the time of his crash.

The grandfather, 50, says he would love to go back and that he missed the job he used to have but the decision that has been made is wrong. His GP has written a letter to support his appeal.

Mr Marseilles who receives support from Headway, the brain injury charity, also has Employment Support Allowance but the latter is set to change following a reassessment from Atos Health Care. The evaluation of Mr Marseilles was that he is fit to work on the basis that he can stand for one minute without assistance and he can talk coherently.

Disabled People Against the Cuts says it would like the system to go back to the times when GP’s who knew their patients, made the decision about their ability to return to work. It went on to say that the patients and their families can go through a ‘deeply distressing’ time if they are incorrectly deemed fit for work.

A representative for the Department of Work and Pensions said that their focus was in getting people back to work if they are capable and giving ‘unconditioal support to those who need it’ pointing out that changes to the existing assessments had been modified and made fairer.
