Personal injury lawyers who work on a no win no fee basis* do not expect legal fees to be paid if you lose your case. If your case is successful then the fees will be paid by the person/persons responsible for any accident. These types of arrangements can be referred to as conditional fee agreements.
The introduction of no win no fee claims system appeared when the government-regulated Legal Aid system was eradicated in 1995. Legal Aid provided funds for those on a low income, who believed they were entitled to compensation. These days there is no formal decision made by an independent body and if your case is taken on this is at the discretion of a solicitor.
We ask our clients to take on board any information and advice we give them and, in turn, we can assure you that you will not need to take out any extra finance to fund your claim and we will not take any fees from your settlement.
Does No Win No Fee *Still Apply If I Lose My Compensation Claim?
This is a commonly asked question and the simple answer is ‘yes’. You will not have to pay a legal fee to your solicitor if you lose your claim. However, you will have to pay costs for the successful party. During the initial assessment of your case, your solicitor will consider all aspects of your claim. At this point, he/she may decide to take out insurance in respect of costs you could incur in the event of a lost case.
After The Event Insurance
The aforementioned insurance is called ‘after the event insurance’. It is a certain type of Legal expenses insurance (LEI) which covers individuals against other policy holders who might take legal action against them.
Costs covered include the winning party’s fees as well as possible medical expenses and court fees. If you win your case then the other party will be liable to pay the premium on your insurance and if you lose, your insurance company will pay it.
Some insurance companies who deal with home and car insurance sometimes offer this element as part of an overall package. However, many claimants do not know of this type of protection.
