A family of a woman who was killed in a motorway accident say they will take civil action against the driver who they believe was at fault for the collision in July last year.
Mollie Haines, 73, was travelling on the M40 to visit one of her daughters. The motorway traffic came to a standstill and when it cleared, she was unable to restart the engine of her car.
Car Was In A Ball Of Flames On The Motorway
A Porsche Cayenne S collided into Mrs Haines’ car forcing her to swerve across the dual carriageway before her vehicle set alight and was in a ball of flames.
Daniel Mitchell, who was driving the Porsche was cleared of causing death by dangerous driving by a jury at Aylesbury Crown Court. He said that he had not seen Mrs Haines’ car and didn’t have time to brake.
The family of Mrs Haines, who was a grandmother of seven, is not happy with the verdict and plan to take civil action against Mr Mitchell.
Mrs Haines’ husband, Dr Charles Haines said that his wife’s death had been a terrible shock for the whole family. He said: “Losing her so suddenly and unexpectedly continues to be a daily struggle for us as she was undoubtedly the centre of our family. We are very disappointed by the verdict. We will take our case to the civil court.”
Claiming Compensation For A Car Accident
If you or a member of your family has been involved in a car accident and the fault of the accident was not your fault then you may be able to claim personal injury compensation.
High speed car accidents can often end in serious injuries and sometimes death for victims. If you have experienced a disabling injury following an accident then it is highly like you will not be able to work for long period of time. Your compensation settlement will take into consideration any loss of earnings you have experienced.
A claim will also factor in the level of pain and suffering your car accident injury has caused you.
If you have lost a member of your family due to a road traffic accident that was the fault of a third party then in many cases you could make a successful claim for personal injury.
In all cases third party blame will need to be demonstrable in order for your case to be successful.
