A motorcycle accident which left a 28 year old man paralysed from the neck down has resulted in a high compensation settlement totalling millions.

Darren Russell from Stockport needs help with breathing and is in a wheelchair following the motorbike accident in 2008.

Lorry Caused Motorcycle Collision

His Kawasaki motorbike collided with a HGV truck as the truck pulled out of a road onto the busy A6 road towards Stockport, failing to spot Mr Russell on his bike.

On impact the motorcycle went up in the air taking Mr Russell with it and slamming him into a nearby building.

He was rushed to the local hospital where he was informed by doctors that he was paralysed from the neck down.

When he was admitted to hospital Mr Russell was put on a ventilator to allow him to breath. This has now been replaced with an internal device which helps control his breathing without a ventilator.

A High court trial in Liverpool took place to establish the details of liability in the incident. The lorry driver’s insurers initially disputed the claims of responsibility although the driver admitted that he did not see the biker.

The details of the accident had been looked at in very close detail by different accident investigators. However, the judge presiding over the case ruled that the lorry driver was 100% liable for the accident.

Out Of Court Settlement

A £4.1 million lump sum with tax free payments of £240,000 a year for care costs for rest of his life was decided. The total amount will depend on Mr Russell’s life expectancy.

It is expected that he will spend the compensation in several different ways in order to live as full a life as possible. The purchase of an adaptable home, therapies, adapted vehicles and wheelchairs will all be obtained.

It was highlighted in court that Mr Russell has adapted to his life changing injuries incredibly well considering the extent of his injuries.
